US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was detained in federal custody.

In her order, the court pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Background of the Case

The court proceedings involve disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in Tennessee.

Terms of Release

The judge, who was overseeing his petition to removal in a federal court, determined that he must now adhere to the conditions of his bond from custody in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
